Terms of Service — Ebb and Ember

  These Terms of Service ("Terms") govern your use of ebbandember.com and the sauna, cold-plunge, and related wellness

  services provided by Elevated Tides Experiences, LLC, doing business as Ebb and Ember Sauna Co. ("Ebb and Ember,"

  "we," "us," or "our"). By booking a session, purchasing a membership or gift card, or using our website, you agree to

  these Terms. If you do not agree, please do not use our services.

  1. Our services

  Ebb and Ember operates floating sauna and cold-plunge sessions, memberships, and related experiences on the Columbia

  River in Portland, Oregon. Session types, availability, hours, and pricing may change at any time without notice.

  2. Booking and payment

  Sessions, memberships, and gift cards are purchased through our online booking platform. Payment is due in full at the

  time of booking unless otherwise stated. All prices are in U.S. dollars. We process payments through a secure

  third-party payment processor and do not store full payment card numbers ourselves.

  3. Cancellations, rescheduling, and refunds

  All sales are final. We do not offer cash refunds. If you cannot attend a booked session, you may cancel through the

  link in your confirmation email and receive a gift card credit for the full amount, which can be applied to a future

  booking or transferred to another person. You may also reschedule by selecting "move booking" to choose another

  available time.

  Sessions are held rain or shine and are not cancelled due to weather, so no refund or credit is issued for weather. We

  reserve the right to cancel or reschedule a session for safety reasons, such as unsafe river or operating conditions;

  in that case you will be offered a reschedule or a gift card credit.

  4. Gift cards

  Gift cards and gift card credits may be applied toward sessions and other offerings as described at the time of

  redemption. Gift cards are not redeemable for cash except where required by law.

  5. Memberships

  Memberships grant the benefits described at the time of purchase, including any included guest passes, at the pricing

  and billing terms shown during signup. Guest passes may only be used when the member is present with the guest.

  Membership benefits, pricing, and terms may change with notice. Details on billing cycle, renewal, and cancellation

  are provided at the time of purchase and in your account.

  6. Health, safety, and assumption of risk

  Sauna and cold-plunge activities on open water involve inherent and significant risks, including exposure to heat and

  cold, cold shock, slips and falls on wet or moving surfaces, river currents, and other hazards. You are responsible

  for knowing your own health limits. If you have any heart, blood pressure, respiratory, or other medical condition, or

  if you are pregnant, consult a physician before participating. You participate voluntarily and at your own risk.

  All participants must sign our Waiver and Release of Liability before participating. You agree to follow all posted

  rules and the instructions of our staff at all times. Jumping or diving is prohibited unless expressly permitted by

  staff.

  7. Conduct

  You agree to treat staff and other guests with respect, to follow all facility rules, and not to participate while

  impaired by alcohol or drugs. We may refuse service to, or remove, anyone who creates a safety risk or disrupts the

  experience, without refund or credit.

  8. SMS text messaging program terms

  Program name: Ebb and Ember SMS

  Description: By opting in, you agree to receive text messages from Ebb and Ember related to your bookings and account,

  such as booking confirmations, session reminders, schedule or weather updates, and customer-care replies. If you

  separately opt in to promotional messages, you may also receive offers and updates about Ebb and Ember.

  Message frequency: Message frequency varies based on your bookings and activity.

  Message and data rates: Message and data rates may apply, according to your mobile carrier plan.

  Opt-out: You can cancel the SMS service at any time by replying STOP. After you send STOP, we will send a one-time

  confirmation message and will no longer send you text messages. To rejoin, sign up again as you did the first time.

  Carriers are not liable for delayed or undelivered messages. Your participation in this program is also governed by

  our Privacy Policy.

  9. Intellectual property

  All content on ebbandember.com, including text, images, logos, and branding, is owned by Ebb and Ember and may not be

  used without our written permission.

  10. Limitation of liability

  To the fullest extent permitted by law, Ebb and Ember and its owners, members, employees, and contractors are not

  liable for any indirect, incidental, or consequential damages arising from your use of our services or website. Our

  total liability for any claim is limited to the amount you paid for the session or membership giving rise to the

  claim. Nothing in these Terms limits liability that cannot be limited under applicable law. The terms of our Waiver

  and Release of Liability control over any conflicting language in these Terms with respect to participation in our

  activities.

  11. Changes to these Terms

  We may update these Terms at any time. Changes take effect when posted to this page. Your continued use of our

  services after changes are posted means you accept the updated Terms.

  12. Governing law

  These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules.
